Building permit or responsible declaration: what you need to renovate in Valencia

For foreign owners, Spanish construction bureaucracy is often the scariest part of a renovation. The reality is simpler than it looks — once you know which procedure applies to your works. In Valencia there are two main routes.

Responsible declaration: the fast track

Most home renovations go through a declaración responsable de obras — a document filed with Valencia City Hall declaring that the works comply with regulations, accompanied by the corresponding technical documentation.

It covers renovations that do not alter the building’s structure or affect protected elements: renovating bathrooms and kitchens, replacing installations, new flooring, moving non-structural partitions, ceilings and finishes.

Its big advantage is timing: once complete documentation is filed, works can start immediately — no waiting months for a resolution.

Building permit: when it is mandatory

The traditional licencia de obra is reserved for major interventions: changes to structural elements (load-bearing walls, floor slabs), extensions, change of use, works on listed or protected buildings, and facade works on protected properties.

Here you must wait for the municipal resolution before starting, and timelines are measured in months — something to factor into your project calendar.

What paperwork is filed

Depending on scope: a technical report or full project (signed by a qualified technician for major works), the works budget, proof of payment of the municipal fee and the construction tax (ICIO), and — in apartment buildings — the community of owners’ authorisation when common elements are affected.

Mistakes we see often

  1. Starting without filing anything “because it’s a small job”: an inspection can stop the works and bring fines.
  2. Filing a minor-works declaration for structural work: liability falls on whoever signs.
  3. Forgetting the community of owners when drains, facade or common elements are involved.
